Summary
La reforma introducida en el Derecho Urbanístico español por el Decreto-ley 8/2011 ha tenido una especial incidencia en las relaciones urbanismo-Registro de la Propiedad. En estas páginas se analiza dicha reforma y se intenta proponer soluciones a los aspectos más polémicos que la aplicación de estas novedades legislativas ha generado en la práctica. Además de los detalles técnicos de cada una de las diferentes normas reformadas, a lo largo de todo este artículo se estudia en profundidad dos cuestiones especialmente controvertidas: la competencia del Estado y de las Comunidades Autónomas, y la situación de los adquirentes de buena fe de viviendas que deben ser demolidas como consecuencia de una sentencia judicial.
Abstract
The Royal Decree-Law 8/2011 has reformed the spanish urban development legislation, with special impact on urban development-land Register relationships. Along these pages I analyze this reform and I try to propose solutions for the most controversial aspects that the new law has caused in its implementation. In addition to the technical details of every reformed norm, through this article I study deeply two disputable matters: the State and regions competencies, and the situation of the good faith purchasers when their houses must be demolished because of a judicial sentence.
