Los derechos de adquisición preferente, a favor del arrendatario rústico, se configuran como una figura problemática en su ejercicio al ser fuente de numerosos litigios, con la consiguiente perturbación que conlleva para el tráfico jurídico. Además en los últimos tiempos, tras los vaivenes legislativos que ha sufrido esta figura, no está claro ni siquiera el sentido de su propia existencia. El presente trabajo se propone suministrar una visión panorámica de los principales problemas que suscitan los derechos de adquisición preferente del arrendatario rústico, al mismo tiempo que se proponen soluciones a cada uno de los problemas enunciados.
Abstract
The rural lessee's right of first refusal is a problematic thing to exercise, leading to a great deal of litigation and eddying the smooth flow of business as a result. In addition, because the pertinent legislation has changed back and forth repeatedly, the very reason why such a right even exists is no longer clear of late. This article proposes to give a panoramic view of the main problems, while proposing solutions for each.
