Summary
Las naciones prosperan cuando los inversores se sienten seguros y están, por ello, dispuestos a invertir en actividades productivas. Pero prosperan aún más si pueden comerciar fuera de su círculo de conocidos, de igual modo que las empresas invierten y se especializan más cuando pueden vender lo que producen en un mercado más extenso. Unas instituciones jurídicas eficaces facilitan estos dos factores esenciales del desarrollo, pues no solo hacen que los inversores se sientan seguros al invertir, sino que también permiten a cualquiera comerciar impersonalmente, generando así riqueza. El análisis en este artículo fundamenta una teoría de los registros públicos según la cual estos posibilitan que el cumplimiento del contrato recaiga directamente sobre los bienes o activos, de modo que los contratantes no precisen información sobre sus contrapartes y puedan, por tanto, comerciar de manera impersonal.
Abstract
People prosper when investors feel secure and are therefore willing to invest in productive activities. But they prosper even more if they can trade beyond their personal circles of known people, as producers invest and specialize more when they can sell their production in a larger market. Good institutions facilitate these two key factors for development, as they not only make investors feel secure in their investments but also enable everybody to trade impersonally, thus creating wealth. The analysis in this article builds a theory of public registries according to which registries make it possible to ground contract enforcement directly on assets, in such a way that transacting parties need no personal information about each other and can therefore trade impersonally.
