Summary
La inscripción de la legítima en el Registro de la Propiedad puede hacerse de diferentes formas. Esta constancia registral dependerá de la naturaleza que tenga la legítima en cada caso, pues, obviamente, si se considera que es parte de la herencia, y el legitimario un heredero, llegará al Registro como derecho real de co-propiedad sobre los bienes hereditarios; pero si se considera que es un valor que debe hacerse efectivo sobre parte de los bienes hereditarios, su acceso al registro se hará de otra manera distinta -por medio de la mención registral-, y en última instancia, ni siquiera deberá tener constancia registral si se entiende que la legítima es un mero crédito frente a la herencia. La naturaleza jurídica de la legítima determina su inscripción en el Registro, y esto es lo que se analiza en este artículo, prestando especial interés a la mención registral de la legítima que recoge el art. 15 LH, en cuanto a sus presupuestos, requisitos de aplicación y efectos.
Abstract
The registration of the legitimacy in the Land Registry can be done in different ways. This registry record will depend on the nature of the legitime in each case, since, obviously, if it is considered to be part of the inheritance, and the forced heir will arrive at the registry as a real right of co-ownership over the hereditary assets, but If it is considered that it is a value that must be made effective on part of the hereditary assets, its access to the registry will be done in another way -by means of the registry mention-, and it should not even have a registry record if it is understood that the legitimate is a mere credit against the inheritance. The legal nature of the legitimate determines its registration in the Registry, and this is what is analyzed in this paper, paying special attention to the registry mention of the legitimacy that includes art. 15 LH, regarding its budgets, application requirements and effects
