Summary
Procede el mantenimiento del primer apellido materno cuando ha sido con el que se inscribió desde su nacimiento al menor al no estar la filiación paterna determinada y en defecto de acuerdo entre los progenitores cuando esta se determina. El interés protegible del menor respecto al cambio del orden de los apellidos es con el que consta inscrito en el Registro Civil, y con el que viene identificado, desde entonces, en la vida familiar, social o escolar. Independientemente de la edad del menor y, por consiguiente, del tiempo que ha venido utilizando los apellidos.
Abstract
The first maternal súmame is maintained when it has been registered with the child since the birth of the child in the absence of the determined paternal affiliation and in the absence of agreement between the parents when it is determined. The protected interest of the child with respect to the change in the order of surnames is that which is inscribed in the Civil Registry, and with which it has been identified since then in family, social or school life.
