Summary
A pesar de que las legítimas representan una de las más emblemáticas y trascendentales instituciones de nuestro sistema sucesorio, a lo largo de la Historia han resultado periódicamente cuestionadas. Tras muchos siglos de imperio de la libertad testamentaria en Roma, la figura de la legítima se cimentó sobre el tránsito del officium pietatis desde el ámbito moral al jurídico en una época tardía del Derecho Romano. Desde entonces nos ha acompañado, si bien con un cariz marcadamente más restrictivo de la autonomía de la voluntad testamentaria que la tradición recibida de las fuentes romanas, hasta su cristalización en nuestro Código Civil. Aunque la discusión en torno a la idoneidad del sistema legitimario y a la conveniencia de la libertad de testar es realmente antigua, se ha repetido cíclica e infructuosamente en relación con nuestro Código. En realidad, la controversia nunca ha cesado. No obstante, las colosales e irreversibles mutaciones socioeconómicas experimentadas en las últimas décadas han propiciado que el debate se haya reabierto con una formidable pujanza: ¿gozan todavía de sentido las vetustas legítimas en el s. XXI, tal y como se configuraron en nuestro Código Civil? En este trabajo prestamos especial atención a las mencionadas transformaciones, y exponemos ciertas situaciones insostenibles que el actual régimen frecuentemente provoca en las sucesiones familiares. Ha llegado, en definitiva, el momento de abordar una profunda revisión del sistema de sucesión forzosa contemplado en nuestro Código, y es una labor que no admite procrastinación.
Abstract
Despite the forced portion is one of the most emblematic and transcendental institutions of our inheritance system, throughout history it has been periodically questioned. After many centuries of testamentary freedom rule in Rome, the forced portion was founded on the officium pietatis’ transition from the moral to the legal sphere in a late period of Roman Law. Since then, it has accompanied us until its crystallization in our Civil Code, albeit with a clearly more restrictive complexion of the testamentary freedom than the tradition received from Roman sources. Although the discussion regarding the forced heirship’s suitability and the testamentary freedom’s convenience is really old, it has been cyclically and unsuccessfully repeated in relation to our Code. In fact, the controversy has never ceased. However, the colossal and irreversible socioeconomic transformations experienced in recent decades have led to renewed burgeoning debate on this subject: does the ancient forced portion still make sense in the 21st century as developed in our Civil Code? In this article we pay special attention to the aforementioned transformations and present some untenable situations often caused in family successions by the current legislation. In short, the time has arrived to undertake a deep review of the forced heirship system in our Civil Code, and this is a task that cannot afford further procrastination.
