Resumen
El ordenamiento jurídico adopta una pluralidad de fórmulas destinadas a favorecer que la libertad positiva de testar, la autonomía, pueda materializarse para que una persona decida de una manera consciente y libre el destino que quiere dar a su patrimonio. Por tanto, cuanto mayor sea la libertad de testar (libertad negativa) más exigente se deberá ser con su libertad para testar (libertad positiva). En estas líneas, dedicadas a la testamentifacción, dos principios pro capacitate y favor testamenti, garantizan que la presunción de capacidad solo se puede desvirtuar mediante la prueba inequívoca e indudable de su carencia.
Abstract
The legal system adopts a plurality of formulas designed to strengthen the positive freedom of testing, autonomy, can materialize for a person to decide in a conscious and free way the destiny he wants to give to his heritage. Therefore, the greater the freedom of testing (negative freedom) the more demanding you should be with your freedom to test (positive freedom). In these lines, dedicated to «testamentifacción», two principles pro capacitate and favor testamenti, guarantee that the presumption of capacity can only be distorted by the unequivocal and undoubted proof of its lack.
