Resumen
El derecho de retención se aborda desde una útil relación de supuestos, asumiendo la sobretutela a favor de la persona que soporta mayor onerosidad y explicando la necesidad de un tratamiento integrador que legitime una trascendencia real, aun cuando el derecho del que traiga causa sea de carácter meramente crediticio; generalizando otros contenidos que, además y antes de un ius distrahendi, sean favorables a un uso ajustado a la naturaleza de la cosa y a su rendimiento económico y social.
Abstract
The retention right can be tackled from its useful roster of assumptions, assuming the overprotection in favor of the person which bears the bigger burden and explaining the need of a conciliatory treatment that le-gitimases a real significance, even when this Right implied only a simply credit cause; applying indiscriminately other contents that, besides and before of the ius distrahendi, are in favor to an adjusted use of the issue’s nature and its own economic and social yield.
