Resumen
El autor pretende averiguar, saber cuál es, en verdad, para el Código Civil español, el concepto, la naturaleza y los principales caracteres de la legítima por lo que resulta de la regulación que se contiene en el conjunto de su articulado. Por encima de la letra de algún artículo que parece pretender definirla, caso del 806, o de expresiones que carecen de justificación, como la de llamar herederos forzosos, a los que gozan de aquel derecho, los legitimarios.
Abstract
The author endeavours to ascertain what the concept, nature and main features of the reserved portion really are for the Spanish Civil Code. Accordingly, the way the reserved portion is regulated in the code as a whole is examined, rising above the strict letter of articles that seem to try and give a definition (e.g., article 806) and unjustified expressions (such as calling the persons who are entitled to a reserved portion "forced heirs").
