Resumen
Delimitadas las características del procedimiento de mediación, es necesaria la diferenciación entre el acta final y el acuerdo de mediación; pues mientras la primera determina la finalización del procedimiento, reflejando si se ha alcanzado algún acuerdo de manera clara y comprensible para todos; el acuerdo de mediación se identifica fundamentalmente con los aspectos concretos de solución a los que han llegado las partes respecto de los conflictos que les afectan. En este sentido, es importante distinguir también quiénes son los sujetos que deben intervenir en cada momento.
Por ello, el fin fundamental de este trabajo es dibujar de manera clara el esquema del procedimiento de mediación, poner de relevancia la importancia de las partes como protagonistas del acuerdo; determinar los requisitos de validez y el contenido del mismo; explicar cuáles son sus efectos y en qué medida se ve afectado por la acción de nulidad de los contratos, para finalmente estudiar su formalización como título ejecutivo.
Abstract
Delineated the features of the mediation procedure is required for differentiation between the final act and the agreement of mediation; so while the first determines the end of the procedure, reflecting whether any agreement had been reached in a clear way and all understandable; the mediation agreement is primarily identified with specific aspects of solution to those who have reached the parties to conflicts that affect them. In this regard, it is important to distinguish also who are subjects that must intervene in every moment.
Therefore, the fundamental purpose of this work is to draw a clear scheme of the mediation procedure, relevant to the importance of the parties as protagonists of the agreement; determine the requirements of validity and the contení thereof; explain what are its effects, and to what extent is affected by the action of nullity of contracts, to finally study its formalization as enforcement.
