Resumen

La inmatriculación por parte de la Iglesia Católica de numerosos inmuebles usando la potestad atribuida por el artículo 206 de la Ley Hipotecaria ha sido de hondo calado público. La razón de ser de esta repercusión social parte de una modificación normativa efectuada en el año 1998 y que permitió a la Iglesia Católica inscribir lugares de culto y otras propiedades que no estuvieran registradas con una mera certificación expedida por el Obispado. La consecuencia de esta reforma fue una intensa actividad registral por parte de las Diócesis. En este proceso, la Iglesia registró a su nombre más de 4.500 propiedades. Tras un breve recorrido por los antecedentes histórico-jurídicos de este precepto, que explican su existencia, en este trabajo se exponen los argumentos en los que basar una posible inconstitucionalidad del artículo 206 de la Ley Hipotecaria, referidos a la violación de los principios constitucionales de aconfesionalidad del Estado y de igualdad. En este sentido, se concluye que este artículo es susceptible de ser declarado inconstitucional puesto que estos principios reconocidos en la Constitución Española chocan con el privilegio de la Iglesia para inmatricular bienes a su nombre con un certificado que firme el propio obispo. Las vías de impugnación ante el Tribunal Constitucional del referido precepto son también objeto de estudio; en concreto el recurso de inconstitucionalidad, con la específica problemática derivada de tratarse de un caso de inconstitucionalidad sobrevenida, y la cuestión de constitucionalidad. La última parte del trabajo se centra en la reciente Sentencia del Tribunal Europeo de Derechos Humanos «Sociedad Anónima del Ucieza contra España», con relevancia específica para el objeto de nuestro estudio.

Abstract

Registration of many buildings by the Catholic Church using the power conferred by Article 206 of the Mortgage Act has been a public matter. A legal modification succeed in 1998 and which allowed the Catholic Church to register places of worship and other properties that were not registered with a mere certificate issued by the diocese. The consequence of this reform was an intense registration activity by the Diocese. In this process, Catholic Church registered over 4,500 properties. After a brief review of the historical background of this legal precept, which explain its existence, we analyze the arguments on which to base a possible unconstitutionality of Article 206 of the Mortgage Act, concerning the violation of constitutional principles as secularism of the State and equality. In this sense, it is concluded that this article is liable to be declared unconstitutional because these principles collide with the privilege of the Church to matriculate property in their name with a certificate signed by the bishop himself. The last part of the paper focuses on the recent judgment of the European Court of Human Rights «SA of Ucieza against Spain», with specific relevance to the subject of our study.
