Resumen
El favor testamenti participa de la nueva configuración europea de la contratación centrada en flexibilizar el ámbito de ineficacia contractual, dándose prevalencia a la voluntad realmente querida por el testador frente a la rigidez de solemnidades y formalismos. Se descarta la necesidad de que el cumplimiento del juicio notarial de capacidad se materialice de modo expreso y ritualista, siendo válidas locuciones distintas que expresen claramente el juicio de capacidad.
Abstract
The favor testamenti is based on the new European configuration for making recruitment more flexible, and focuses on contractual inefficiency. It confronts inflexibility and formalities allowing the true wishes of the testator to prevail. It will not be necessary to carry out simple and fast judgment with the compliance of a notary. There will be valid phrases that clearly express judgment on how to proceed.
