Resumen
El presente trabajo tiene como finalidad comentar la sentencia del Tribunal Supremo, de 6 de febrero de 2014, que afirma la imposibilidad de proceder en nuestro país a la inscripción en el Registro Civil del nacimiento de los menores nacidos mediante la técnica de reproducción asistida, conocida como «gestación por sustitución» o «maternidad subrogada», así como de la filiación de los mismos respecto de quienes hayan recurrido a tal técnica en un país extranjero, ya que el convenio que da lugar a la realización de la misma es nulo, tal y como establece el artículo 10 de la Ley 14/2006, de 25 de mayo, reguladora de las técnicas de reproducción humana asistida, precepto que es considerado por el TS como perteneciente al orden público internacional, por lo que ni siquiera puede darse cobertura jurídica a la solicitud de inscripción acudiendo al interés superior del menor.
Abstract
This paper aims to discuss the Supreme Court judgment of February 6, 2014, which claims the inability to come to our country to the registration in the Registry of the birth of children born through assisted reproduction technique known as «surrogacy» or «surrogate motherhood» and the affiliation of the same in respect of whom have resorted to such a technique in a foreign country, as the agreement leading to the realization of it is zero, as established in art. 10 of Law 14/2006, of 25 May, regulating assisted human reproduction, a provision that is considered by the Supreme Court as part of the international public order, so you can not even give legal cover to the request for registration going to the interests of the child.
