LOS DEBERES DE INFORMACIÓN PRECONTRACTUAL EN LA LEGISLACIÓN ACTUAL Y EN LAS DISTINTAS PROPUESTAS DEMODERNIZACIÓN DEL DERECHO DE OBLIGACIONES.

Resumen
En el presente trabajo pretendemos analizar cuál es el régimen de los deberes de información previa que, en el marco de una futura relación contractual, necesariamente ha de aportar una parte a la otra (generalmente, pero no de modo exclusivo, en contratos de consumo por parte del empresario al consumidor). A tal efecto, analizaremos cuál es ese tratamiento en la legislación actualmente vigente, tanto española, especialmente en el Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios, como europea; y cómo se abordó en la Propuesta de Modernización del Código Civil en materia de Obligaciones y Contratos de la Comisión General de Codificación. Asimismo, estudiaremos el régimen de estos deberes de información precontractual en el ámbito del futuro Derecho privado europeo armonizado, tanto en el Proyecto de Marco Común de Referencia como en los recientes Estudio de Viabilidad del Grupo de Expertos y «Derecho de compraventa común europeo».
Abstract
This paper looks into the system of rules surrounding the information that one party to a future contractual relationship must necessarily give the other before the contract is made (generally, but not exclusively, information that a business must give a consumer before making a consumer contract). Current legislation is examined to see how it deals with pre-contract obligations. This includes Spanish law, especially the Revised General Act on Consumer Defence, and European law. It also includes the approach taken by the Legislation Commission in the Proposal to Modernise the Civil Code in matters of Obligations and Contracts. The Draft Common Frame of Reference, the recent feasibility studies of the Expert Group and Common European Sales Law are reviewed for a picture of how harmonised private European law will in future address the duties concerning pre-contract information.
