Resumen
El interés por la conservación y protección de las casas cueva tiene carácter multidisciplinar. Desde el punto de vista jurídico los problemas que se plantean van relacionados sobre todo con la prueba de su titularidad, la utilización del subsuelo y con su constatación en el Registro de la propiedad. La interrelación de la legislación civil e hipotecaria junto con la legislación del suelo y protectora del patrimonio se hace fundamental para la defensa y el entendimiento de esta forma de hábitat que tan característica es de algunas zonas de nuestra geografía y que tanta importancia está adquiriendo en los últimos tiempos desde el punto de vista turístico. Por otro lado, en este artículo se pretende analizar, dadas las frecuentes e inevitables relaciones de los propietarios de las cuevas con sus vecinos y con la Administración pública, los desencuentros que, en materia de responsabilidad por daños, provocan la acción del agua y la actuación humana.
Abstract
The interest in the conservation and protection of the cave houses are multidisciplinary. From the legalpoint of view the problems that arise are related mainly with proof of ownership of the cave houses, use of the subsoil and its finding in the Land Registry. The interrelation of Civil and mortgage legislation with legislation of land and heritage protection is fundamental to the defence and understanding of this type of habitat that is so characteristic of some areas of our country and how much is gaining in importance nowadays from the point of view of tourism. Furthermore, this article aims to analyse, given the frequent and inevitable neighborhood relations and with the public administration, the disagreements on liability for damages that produces the action of water and human performance.
