Resumen
El ejercicio de la patria potestad presenta un complejo conjunto de derechos y obligaciones, de gran responsabilidad y que adquiere mayor complejidad en los casos de separación o divorcio. La distribución de funciones entre los padres no es una tarea fácil ni pacífica que genera un buen número de enfrentamientos entre las partes a pesar del cuidado con que el juez y el legislador las hayan dispuesto. El establecimiento de acuerdos entre las partes ante la eventualidad de crisis en la pareja es otra forma de abordar el problema por algunas legislaciones más modernas. Dentro de esos deberes, se suscita si el cambio del domicilio por el progenitor custodio le corresponde a él, o si por el contrario, es una decisión común de patria potestad. Las consecuencias pueden ser delicadas, si además el cambio del domicilio es a un país extranjero. La jurisprudencia ha ido interpretando el Ordenamiento de forma que a pesar de los intereses enfrentados, la primacía sigue siendo atender lo que mejor convenga al menor.
Abstract
The exercise of the parental authority presents a complex set of rights and obligations, of great responsibility and that acquires greater complexity in cases of separation or divorce. The distribution of functions between the parents is not an easy task nor Pacific generated a number of clashes between the sides despite the care with which the judge and the legislature have arranged them. The establishment of agreements between the parties in the event of crisis in the couple is another way to address the problem by some more modern legislation. Within these duties, it raises if the change of domicile to the parent custodian corresponds to it, or if on the contrary, it is a common parental decision. The consequences can be sensitive, if the change of domicile is in a foreign country. The jurisprudence has been interpreting the order in a way that despite the conflicting interests, the primacy continues to be ate.
