Resumen
La promoción inmobiliaria encubierta es un fenómeno bastante común y se desarrolla especialmente en las cooperativas de viviendas y comunidades de propietarios. En épocas de crisis inmobiliaria y financiera como la actual, estos agentes proliferan y con ellos el citado fenómeno.
A los responsables se les debe exigir las mismas obligaciones que a un promotor normal y los afectados deben gozar de las mismas garantías y derechos que posee un consumidor en la compraventa de una vivienda.
En este estudio se proponen medidas para evitar la promoción encubierta entre las que destaca la necesidad de potenciar organizaciones de consumidores para defender de forma asequible sus derechos y la de considerar como promotor al gestor de cooperativas o comunidades, salvo que pruebe que se ha limitado a gestionar.
Abstract
Fraudulent real estate promotion is quite a common phenomenon and it develops especially in housing cooperatives and community properties. In periods of real estate and financial crisis as the current one, these agents proliferate and with them the aforementioned circumstance.It is necessary to demand the same obligations from the people in charge as from a normal real estate promoter and those affected must have the same guarantees and rights that a consumer in the purchase of housing.
In this study measures are proposed to avoid fraudulent real estate promotion, such as the need to promote consumer organizations to defend affordably their rights and the need to consider the manager of housing cooperatives or communities to be a real estate promoter, unless he has demonstrated that his role is limited to management"
