Resumen
En el presente estudio analizamos la regulación de la promesa de matrimonio [arts. 42 y 43 CC] y las implicaciones que comporta para los promitentes. En el texto nos detenemos en el estudio del artículo 42 del Código Civil desde su precedente mediato hasta la redacción definitiva dada tras el proceso de tramitación parlamentaria de la Ley 30/1981, de 7 de julio. Tras la descripción de la evolución jurídica de la medida, nos ocupamos del valor jurídico que presenta la promesa, enfatizando que el precepto sigue negándole el carácter de fuente de la obligación para contraer el matrimonio, ya que esta comporta únicamente un compromiso de contraer nupcias con una persona, pero desde la perspectiva jurídica no supone obligación alguna de contraerlo. Como innovación señalamos la adición de la falta de efectos de la estipulación prevista para el supuesto de no celebración de las nupcias y hacemos referencia a la inadmisión a trámite de la demanda sobre el cumplimiento de la promesa. Asimismo, nos detenemos en las modificaciones de detalle que presenta el artículo 43 del Código Civil respecto de la anterior regulación de la figura; analizamos las diversas posturas doctrinales asumidas a lo largo del tiempo en orden a la naturaleza que presenta la medida y al fundamento de la obligación resarcitoria; a la reforma acaecida por los requisitos y al alcance de la obligación de reembolso. Finalmente, analizamos la imposibilidad del reembolso del lucro cesante y de los daños morales derivados de la ruptura sin causa de la promesa.
Abstract
In the present study we analyze the promise of marriage regulation [arts. 42-43 CC] and the implications that this act brings to the promisors. In the text we focus on the study of article 42 CC from its mediate precedent until the definitive legal text given after parliamentary processing of the Law no. 30/1981. After the description of the juridical evolution of the extent, we take care of the juridical value of the obligation, underlining that the provision still denies its character as source of duty of marriage, since it implies solely a marriage agreement with another person, but from a legal perspective it does not imply any obligation of getting married. This work also points out, as an innovation, the lack of effects of legal standards in case of promisors don't get married , and also study the non admittance of procedure of the lawsuit about the promise compliance. Additionally, we look carefully at punctual modifications on article 43 CC regarding the regulation of this legal entity; we analyze various doctrines adopted since long time ago referred to the nature of the extent, and to the basis of indemnity responsibility, and finally to the amendment due to requirements and to the scope of monetary compensation. Finally, we take a look to the impossibility of reimbursement of loss of earnings and moral damages coming from breach of promise without a cause.
