Resumen
La porción legítima en la actualidad es el resultado de una evolución histórica que arranca desde el Derecho romano, pasando por la influencia germánica, hasta desembocar en la codificación francesa. El modelo francés es adoptado por la mayoría de los ordenamientos jurídicos pertenecientes a la familia del derecho romano, aun cuando entre cada uno de ellos puedan mediar diferencias en torno a las personas legitimarias, la cuota de la porción legítima y su naturaleza jurídica.
Abstract
The compulsory share today is the result of a historical development that starts from Roman law, through the Germanic influence, until reaching the French codification. The French model is adopted by most legal systems belonging to the family of Roman law, although between each can mediate differences on the beneficiaries, share the portion and the legal nature.
