Resumen
Se aborda en este trabajo, a propósito de la reciente sentencia del Tribunal Supremo, de 19 de diciembre de 2006, la problemática existente en cuanto al reconocimiento de personalidad jurídica de las sociedades irregulares, al ser éste un tema bastante debatido doctrinalmente y nada claro a nivel jurisprudencial. Asimismo y al hilo de dicha sentencia, se analiza el régimen de responsabilidad de los socios de tales sociedades irregulares, según el tratamiento realizado del mismo.
Abstract
In regard to the Supreme Court's recent ruling of 19 December 2006, this paper addresses the problem of the acknowledgement of legal personality for irregular companies, as this topic is under considerable doctrinal debate and remains unclarified by case law.
The system of liability of the partners in irregular companies is also analysed, following the train of said ruling and according to the treatment of said system.
