Resumen

Este trabajo estudia la relación que existe entre la facultad de anticipar el cumplimiento por insolvencia del deudor que contempla el artículo 1129.1 del Código Civil y el concurso de acreedores regulado en la Ley Concursal 22/2003, de 7 de julio. Se intenta demostrar: 1) que el ejercicio de la facultad del artículo 1129.1 del Código Civil no solo no requiere la previa apertura del concurso, sino que, por el contrario, es necesario que el concurso aún no se haya abierto; 2) que la pluralidad de acreedores es un presupuesto implícito de esta facultad, y que, por tanto, la declaración de concurso es una consecuencia inminente en caso que opere el supuesto del artículo 1129.1 del Código Civil; y 3) que la eficacia de un pago hecho bajo el amparo de la facultad de anticipación del artículo 1129.1 del Código Civil es dudosa, debido a la forma en que la Ley Concursal regula la acción rescisoria dentro del concurso, y, sobre todo, porque se trata de una regla que no encaja bien con los principios de la moderna legislación concursal.

Abstract

This paper deals with the relationship between the creditor's faculty to require the anticipated performance of the obligation in case of «insolvency» (article 1129 of Spanish Civil Code -CC-) and the Spanish Bankruptcy Act 22/2003 (July, 7). It is proposed that: 1) art. 1129.1 CC requires that there is no bankruptcy proceeding; 2) plurality of creditors is an implicit condition of this faculty, and that opening insolvency proceeding is an imminent and inevitable consequence if the event of article 1129.1 CC occurs; and 3) the efficacy of a payment made under article 1129.1 is questionable, regarded the regulation of the actio pauliana in the Bankruptcy Act, and, mainly, since this rule is against the principles that govern the modern insolvency proceeding.
