Resumen
El orden de los apellidos se ha sometido a una nueva regulación en la Ley de Registro civil de 2011. Con ello se elimina en nuestro ordenamiento el conceder primacía al apellido paterno sobre el materno. A pesar de los intentos legislativos anteriores a la reforma para eliminar esta primacía no ha sido hasta esta nueva ley que no se ha eliminado la discriminación al permitir que los padres elijan el orden de los apellidos (logro que se consiguió en 1999) y, en su ausencia, delegar en el Encargado del Registro civil la elección del orden de los apellidos en función del interés superior del menor. Se valora la nueva norma, la función del Encargado del Registro civil y el significado del interés superior del menor a la luz de la LO 8/2015, de 22 de junio. Similar solución se ha seguido en el Código civil argentino de 2014, aunque con ciertos matices.
Abstract
The order of surnames has been subject to a new regulation in the Civil Registry of 2011. This eliminates in our legal system giving primacy to the surname of the mother. Despite previous attempts to legislative reform to elimínate this primacy, has been this new law which has eliminated discrimination by allowing parents to choose the order of surnames (achievement that was achieved in 1999) and, in his absence, delegate the choice of the order of the surnames based on the best interests of the child in the civil registry officer. Appreciates the new standard, referral to the officer of the civil registry and the meaning of the best interests of the child in the light of the draft law to the childhood, reaching similar conclusions to the reflected in the Civil Code of Catalonia or in the new civil code Argentino de 2014, although with nuances.
