Resumen
La regulación de la cosa juzgada en los apartados 3 y 4 del artículo 19 de la Ley de Jurisdicción Voluntaria se configura como una las principales novedades, en el plano de la dogmática jurídica, del nuevo modelo de Jurisdicción Voluntaria.
Conforme a la nueva regulación, las resoluciones de JV no comportan efectos de cosa juzgada material fuera del ámbito de la propia JV, pero sí en este ámbito, en sus efectos negativo y positivo, por lo que la usual afirmación de la ausencia cosa juzgada en la jurisdicción voluntaria, debe matizarse en el sentido de que dentro del propio ámbito interno de la JV sí produce efectos de cosa juzgada, en sus efectos positivo y negativo, la resolución con la que se finaliza el expediente. Unas mismas resoluciones no pueden existir y dejar de existir para las distintas Jurisdicciones: voluntaria y contenciosa, razón por la que las resoluciones con fuerza de cosa juzgada material, dictadas en el marco de la JV, despliegan sus efectos positivos prejudiciales, no solo sobre la propia JV, sino también sobre la Jurisdicción Contenciosa. Negar efectos de cosa juzgada material a la jurisdicción voluntaria, en su propio marco, introduciría una peligrosa variable, que solo generaría inseguridad jurídica a los justiciables y al propio funcionamiento de la Administración de Justicia.
Abstract
In terms of legal doctrine, the regulation of res judicata in paragraphs 3 and 4 of artículo 19 of the Voluntary Jurisdiction Law is configured as one of the main developments of the Voluntary Jurisdiction new model.
According to the new regulations, resolutions of Voluntary Jurisdiction, outside the scope of Voluntary Jurisdiction have no effect of res judicata, but it is in this area, the resolutions has negative and positive effects, so the usual statement related to no res judicata on voluntary jurisdiction, should be qualified in the sense that the resolution which ends the proceeding in the domestic scope of Voluntary Jurisdiction does produce the effect of res judicata in its positive effects and negative. A same resolutions can not exist and cease to exist for voluntary jurisdiction and subsequently to the contentious jurisdiction, for this reason decisions which are res judicata issued under the Voluntary Jurisdiction have prejudicial positive effects not only on Voluntary Jurisdiction but also on Jurisdiction Contentious. Denying the effect of res judicata to the voluntary jurisdiction, within its own framework, introduce a dangerous variable, and would create legal uncertainty for litigants and for the Justice Administration own performance.
