INTRODUCCIÓN AL DOCUMENTO DE INSTRUCCIONES PREVIAS (VOLUNTADES ANTICIPADAS) EN EL DERECHO ESPAÑOL. ALGUNAS CLAVES PARA SU ESTUDIO.

Resumen
Se exponen en este estudio, de entrada, las coordenadas del contexto histórico y conceptual en que se encuadra esta realidad asistencial y jurídica, designada en la legislación española con denominaciones diversas: documento de instrucciones previas, voluntades anticipadas, testamento vital, etc. Tras una breve reseña de esta legislación con observaciones críticas, ofrezco un examen introductorio de varios aspectos de su régimen jurídico y problemas que plantea: el otorgante y su capacidad, el contenido del documento, con una reflexión relativa a la figura del representante sanitario, y cuestiones relativas a la eficacia y límites del documento. Finalmente se incluyen observaciones acerca de su valor e impacto en el contexto de la denominada planificación anticipada de la atención al final de la vida.
Abstract
The present study primarily sets forth the guidelines of the historical and conceptual context that fits this legal and care reality, designated by the Spanish legislation with different names: advance directive, living will. After a brief review of this legislation, I offer an introductory examination of various aspects of its legal regulation, as well as other related problems: the grantor and his capacity, the content of the document with a reflection on the figure of the health representative, and issues according to the effectiveness and limits of the document. Finally, it also includes observations about its value and impact in the context of the so-called advanced care planning at the end of life.
