Resumen
Si bien se ha afirmado que la materia inmobiliaria está excluida de los Tratados que rigen la Unión Europea, es lícito preguntarse si es posible una armonización que sin violentar el derecho material interno de los Estados procure una mayor uniformidad en el tratamiento de la publicidad de los derechos que recaen sobre inmuebles. El desarrollo de esta idea, que no es nueva, se contempla desde el punto de vista competencial de la Unión, desde el punto de vista académico y desde la perspectiva de los antecedentes legislativos para concluir que no solo es posible llevar a cabo una armonización sino que sería altamente conveniente.
Abstract
Although it has been asserted that property matters are not covered by the treaties governing the European Union, it is still valid to raise the question of whether it might be possible to institute some sort of harmonization for greater uniformity in the way Member States handle the disclosure of rights in immovable property without warping Member States' domestic substantive law. The implementation of this idea, which is not new, is examined from the standpoint of EU competences, the academic standpoint and the standpoint of legislative antecedents. The conclusion is that such a harmonization is not only possible, but highly advisable.
