Resumen
En el presente artículo la autora analiza la reforma introducida en la Ley Concursal por el Real Decreto-ley 1/2015, de 27 de febrero, de mecanismo de segunda oportunidad, reforma que consolida legalmente una tendencia jurisprudencial existente que concedía una exoneración del pasivo insatisfecho tras la liquidación concursal a deudores consumidores sin recursos. Tras examinar los requisitos objetivos y de trámite para el acceso a las dos modalidades de fresh start existentes, se explicitan los requisitos subjetivos (buena fe objetivada legal-mente) que han de concurrir en el deudor solicitante. Concluyendo con el examen de las diferencias entre las dos vías de segunda oportunidad (satisfacción de un umbral de pasivo mínimo en la liquidación concursal o sometimiento al plan de pagos), y sus efectos sobre los créditos de los acreedores en caso de revocación del beneficio, en los cinco años posteriores, así como en el caso de consolidarse el beneficio obtenido.
Abstract
In this article the author examines the reform introduced into the Insolvency Law by Royal Decree-Law 1/2015 of 27 February, on the second-chance mechanism, a reform which consolidates into law an existing case law practice whereby consumers without resources had unpaid debts written off following the bankruptcy settlement. After examining the objective and procedural eligibility requirements for the two existing ‘fresh-start' arrangements, there follows an explanation of the subjective requirements that the applicant debtor must meet (good faith objectively determined by law). The article concludes with an examination of the differences between the two second-chance channels (meeting the requirement for a minimum debt threshold in the bankruptcy settlement or agreeing to be subject to the repayment plan), and their effects on creditors' loans in those cases where this status is revoked or consolidated in the five years following the decision.
