Resumen
La reciente Sentencia del Tribunal Constitucional español 93/2013, de 23 de abril, sitúa al artículo 10.1 de la Constitución Española (el principio general del libre desarrollo de la personalidad) en el centro de la protección jurídica que merecen quienes libremente eligen no casarse. El legislador debe respetar esta libre opción, de manera que no puede imponerles la constitución de una unión de hecho ni un régimen jurídico imperativo vinculado a ello, salvo que así lo hayan consentido. Esta Sentencia reitera la opinión general de que la autonomía de la voluntad de las parejas de hecho para regular sus relaciones económicas o patrimoniales (y también algunas personales) es la mejor forma de darles certidumbre y solucionar conflictos, porque nadie mejor que ellos conoce su situación actual y sus previsibles necesidades futuras.
Abstract
The recent Decision of the Spanish Constitutional Court 93/2013, of the 23rd of April situates the article 10.1 of Spanish Constitution (general principle of free development of the personality) in the center of legal protection who people who freely choose not marrying deserve. The legislator must respect this free option and isn't allowed to impose them a formation as a couple by fact or a linked imperative juridical regime, if they don't approve it. This Decision reiterates the general opinion that the autonomy of the will of stable couples for organizing their financial or patrimonial relationships (and some personal too) is the best way to give them security and solve disagreements, because nobody knows better than them their actual situation and their expected needs.
