Resumen
El consentimiento voluntario para la realización de las técnicas de reproducción asistida y la voluntad de concebir un hijo por parte de la mujer casada con la madre biológica posibilita el ejercicio de la acción de reclamación de filiación por posesión de estado y sirve como título de atribución de la maternidad. Posesión de estado que surge del matrimonio y en donde debe primar el interés de los hijos y la estabilidad familiar.
Abstract
The voluntary consent to the carrying out of assisted reproduction techniques and wish to conceive a child on the part of the married woman with the biological mother, makes the exercise of claiming for affiliation of state possession and acts as title of attribution of motherhood. Ownership status arises from the marriage and must prioritize the interests of the children and the stability of the family.
