Resumen
La consideración de la procedente ejecución de la urbanización en plazo en una actuación integrada como deber legal y su correlativo incumplimiento como infracción urbanística expresamente tipificada como tal por el legislador determina que por la administración haya de tramitarse el correspondiente procedimiento administrativo de incumplimiento del respectivo deber y de cambio de sistema de actuación, procedimiento cuya iniciación y resolución final es susceptible de ser inscrita en el Registro de la Propiedad siempre y cuando sea objeto de tramitación con audiencia previa de los titulares de derechos reales inscritos, correspondiendo al registrador el control del cumplimiento de los trámites esenciales del procedimiento y, con ello, la verificación, en su caso, del carácter irrelevante de los eventuales defectos formales cuando no fueran causantes de indefensión material.
Abstract
The obligation to develop an integrated urban program in due time is considered a legal duty. The failure to develop in due time is considered an infringement of administrative law. In order to declare said infringement and to change the system to develop the integrated urban program, the administration has to open an administrative procedure. Opening and conclusion of the administrative procedure to declare the infringement may be recorded in the Land Registry after hearing other registered rights in rem holders. The Registry is under an obligation to confirm that all the essential requirements have been meet. If any formal defects are detected, the Registry has to confirm that they are not relevant and have not caused any material breach of the rights of defense.
