Resumen
En la Resolución de la Dirección General de los Registros y del Notariado de 25 de julio de 2014 se admite que el cónyuge del socio casado en gananciales se encuentra legitimado para solicitar del Registro Mercantil el nombramiento de un auditor, sin que se haya analizado la cuestión desde la general y natural ajenidad que para la correspondiente sociedad supone el carácter privativo o ganancial de la participación social.
Abstract
The Decision of the Directorate-General of Registries and Notarial Affairs of 25 July 2014 admits that, when a shareholder is married under a com-munity property regime, the shareholder's spouse is entitled to apply to the Business Registry to have an auditor appointed. The decision does not look at the question in terms of the fact that, for the company, whether the shares are owned as com-munity property or not is generally (and naturally) a non-issue.
