Resumen
El derecho de superficie como derecho real limitado de goce es una figura que gozando de una gran historia jurídica no ha tenido mucha atención por la doctrina. Sin embargo, en los últimos años, ha comenzado a ser estudiada como figura que permite solventar los problemas económicos que plantea la adquisición del suelo para edificar, en el ámbito urbano, o plantar y sembrar, en el rústico.
En el Derecho español, la figura no goza de una regulación legal completa, e incluso, civilmente, su posición sistemática en el Código provocó graves confusiones. La escasez de regulación ha provocado problemas importantes no solo en cuanto a su configuración como derecho real independiente, sino también en cuanto a los requisitos formales necesarios para su constitución válida. A través de este trabajo vamos a analizar estos puntos atendiendo a la jurisprudencia.
Abstract
The surface right as real right limited enjoyment is a figure that enjoy a great legal history has not had a great deal of attention by the doctrine. However, in recent years, has begun to be studied as a figure that allows to solve the economic problems posed by the acquisition of land for building, in the urban area, or planting and sowing, in the rustic.
In the Spanish Law, the figure does not enjoy a full legal regulation, and even civilly, their consistent position in the code caused serious confusion. The scarcity of regulation has caused major problems not only in regard to its configuration as real right independently but also in regard to the formal requirements for its valid constitution. Through this work we are going to analyze these points on the basis of the Jurisprudence.
