Resumen
Existencia de daños morales derivados de la ocultación por la esposa de que no era el padre del hijo habido durante el matrimonio. Daño consecuencia directa de un atentado a un bien no patrimonial como es la inexistencia de paternidad de un hijo al que se consideraba suyo. hijo nacido dentro del matrimonio, cuya creencia de paternidad se basaba en la confianza generada en el contrato matrimonial. El daño surge de la ocultación y el mantenimiento del engaño que origina la creencia de la relación paternofilial, con todos los derechos y deberes fruto de la institución jurídica de la patria potestad. La única persona que podría proporcionarle tal conocimiento, la esposa, no solamente no lo hizo, sino que mantuvo una posición contraria a la realidad.
Abstract
Existence of moral damages derived from the concealment by the wife that the husband was not the father of the child during the marriage. Damage direct consequence of an attack on a non-patrimonial property such as the absence of paternity of a child to whom it was considered his. Son born inside the marriage, which belief of paternity was based on the confidence generated in the matrimonial contract. The damage arises from the concealment and maintenance of the deception in the belief of the relation paternofilial, relationship, with all the rights and duties resulting from the legal institution of parental authority. The only person who could provide such knowledge, not only did not, but maintained a position contrary to reality.
