Resumen
El presente trabajo constituye una revisión de los fundamentos que tradicionalmente han concebido por la doctrina que el cumplimiento de la obligación realizado por el representante es cómo si lo hubiera realizado el propio deudor. Sin embargo hoy, la doctrina civil debe replantearse tal aseveración partiendo de la determinación de los presupuestos de la representación voluntaria y el propio cumplimiento de las obligaciones; teniendo en consideración las múltiples teorías que en relación a ambas categorías se han esgrimido. Aunque se pretenda justificar como una fictio iuris, lo cierto es que concebir el cumplimiento del representante como el realizado por el propio deudor, tanto por la legislación y la doctrina, resulta improcedente. Esta concepción entra en franca contradicción con la concepción del régimen de responsabilidad entre el actuar del representante y el actuar del deudor.
Abstract
This paper is a review of the fundamentals that have traditionally conceived by the doctrine that the fulfillment of the obligation undertaken by the representative is how if I had done the debtor. But today, the civil doctrine should rethink that assertion based on the determination of the budgets of agency and self-fulfillment of obligations; taking into account the multiple theories relating to both categories have been raised. Although attempts to justify as a legal fiction, the truth is that conceiving compliance rep as performed by the debtor himself, both by law and doctrine, is inappropriate. This design comes in clear contradiction with the conception of the liability regime between acting and acting representative of the debtor.
