Resumen
En este artículo vamos a exponer las principales consecuencias que se derivan de la inclusión del nuevo apartado e) en el artículo 5 de la LAU, el referente a las exclusiones, que comienza a tener su máxima relevancia en nuestros días, concretamente a raíz de la proliferación de los alquileres turísticos y de su regulación en las distintas Comunidades Autónomas. Sin embargo, aunque pudiera parecer prima facie la exclusión de un tipo concreto de arrendamientos, veremos cómo existen importantes condicionantes que la matizan.
Abstract
In the present article, we will study the main consequences resulting from the inclusion of the new paragraph e) of article 5 of the LAU, the one regarding the exclusions, which is becoming increasingly relevant es- pecially nowadays, as a result of the proliferation of the holiday rentals and its regulation in the different Autonomous Communities. However, even if it may seem, prima facie, to be the exclusion of a particular type of leases, we will see how it is qualified by important factors that must be taken into account.
