Resumen
En el presente estudio se analizan los criterios utilizados por los Tribunales para controlar la cantidad reclamada por la entidad de crédito prestamista al prestatario como consecuencia del incumplimiento del pago de alguno de los plazos. En concreto, nos centramos en el análisis de las cantidades reclamadas en concepto de capital, intereses remuneratorios e intereses de demora. En el primer caso se estudia en qué casos y bajo qué circunstancias el incumplimiento del prestatario desencadena la posibilidad de exigir también el capital no vencido. En relación a los intereses remuneratorios, nos adentramos en el control en España de los intereses usurarios, a la vez que se hace un análisis de la legalidad de las cláusulas suelo. Y, en lo tocante a los intereses moratorios, se analiza la posible moderación o supresión en sede judicial de los intereses pactados por el hecho de que se consideren excesivos. A la hora de estudiar todas estas cuestiones se tiene especialmente en cuenta la incidencia que podría tener en la regulación el Proyecto de Código Mercantil si fuera finalmente aprobado. El artículo concluye con una referencia a la posibilidad del prestamista de excepcionar en los procesos monitorio e hipotecario estas circunstancias, así como que las mismas puedan ser apreciadas de oficio por el juez.
Abstract
In this paper it is analyzed the criteria used by courts of law to control the amount legally claimed by the lender credit institutión to the borrower as a consequence of the non-payment of any instalment. Specifically, we focus on the analysis of the sum of money claimed as principal, remunerative interest and default interest. In the former case, it is studied under which circumstances the borrower's default makes also the non-expired amount claimable. On the matter of remunerative interest, we go in depth into the control in Spain of usurious interest and we make an analysis of legality of floor clauses. Regarding default interest, it is analyzed the possibility that agreed interest were judicially reduced or suppressed because of being considered excessive. In studying all these issues, it is taken into account the effect that the Draft Commercial Code Bill could have if it were finally approved. The paper finishes with a reference to the lender's possibility of raising all these issues as a defense in small claim proceeding or in foreclosure process as well as to the possibility that the court ex officio were entitled to rule on them.
