Resumen
Frente a la posición mantenida por el Tribunal Superior de Justicia de Madrid en su reciente sentencia de 20 de junio de 2017 según la cual la regla general del carácter no constitutivo de la inscripción determina que no sea obligación de las Juntas de Compensación procurar la inscripción de los Proyectos de Compensación, resulta preciso destacar la falsa disyuntiva que encierra pues mientras tal carácter no constitutivo se refiere a la existencia del derecho, la obligatoriedad de la inscripción supone una excepción al principio de inscripción voluntaria que es susceptible de concurrir por su previsión legal, por exigencias vinculadas a la seguridad jurídica del tráfico inmobiliario y por la presencia de razones de interés público que así lo demanden, lo que se da en general en el caso de los instrumentos reparcelatorios y, en particular, en el de los Proyectos de Compensación con la consiguiente consecuencia de extender el deber de las Juntas de Compensación también al de alcanzar su inscripción.
Abstract
Faced with the position maintained by the Superior Court of Justice of Madrid in its recent sentence of June 20, 2017, according to which the general rule of the non-constitutive nature of the registration determines that it is not an obligation of the Compensation Boards to seek the registration of Plot Redivision Projects, it is necessary to highlight the false disjunctive that it contains because while this non-constitutive character refers to the existence of the right, the obligatory nature of the registration supposes an exception to the principle of voluntary registration that may concur because of its construction by the law, for requirements related to the legal certainty of the real estate traffic and the presence of public interest reasons, and it happens so in the case of plot redivision instruments and, in particular, in the case of Compensation Projects, with the consequence of extending the duty of the Compensation Boards also to reach their registration.
