Resumen
En el presente trabajo pretendemos poner de manifiesto cuál es el régimen jurídico a través del que se articula la prestación del consentimiento para la realización de actuaciones sanitarias por parte de las personas con discapacidad que han sido incapacitadas. En ese régimen ocupa un papel destacado la intervención de los guardadores legales de los incapacitados, tanto titulares de la patria potestad como tutores, e incluso los curadores y aun los guardadores de hecho en ciertas circunstancias. Haremos referencia tanto al sistema general de prestación de dicho consentimiento como a los regímenes especiales para los supuestos de interrupción voluntaria del embarazo y esterilización, aplicación de las técnicas de reproducción asistida, realización de ensayos clínicos e investigaciones biomédicas y práctica de trasplantes.
Abstract
In this paper we try to show how is the legal system through which it is articulated the granting of consent for the performance of health care practices by disabled people who have been declared incapacitated. In this regime, it is remarkable the prominent role of the intervention of the legal guardians of the disabled persons, both holders of parental authority as guardians, and even curators and de facto keepers in certain circumstances. We will refer to both the general system about such consent as to the special regulations for cases of voluntary termination of pregnancy and sterilization, application of assisted reproduction techniques, clinical trials and biomedical research and practice of transplantation.
