Resumen
RESUMEN: En el presente trabajo se analiza el complejo marco normativo al que se ven sujetas las viviendas turísticas en el ordenamiento jurídico español y se estudian las molestias y principales controversias que generan en los edificios sometidos a un régimen de propiedad horizontal. Se examinan las posibilidades de actuación con las que cuentan las comunidades de propietarios para hacer frente a estas situaciones, a la luz del novedoso apartado 12.º del artículo 17 de la Ley de Propiedad Horizontal introducido por el Real Decreto-ley 7/2019, de 1 de marzo, de medidas urgentes en materia de vivienda y alquiler.
Abstract
This paper analyzes the complex regulatory framework to which tourist housing is subject in the Spanish legal system and studies the nuisances and major controversies that they generate in buildings subject to a horizontal property regime. It examines the possibilities of action available to communities of owners to deal with these situations, in light of the new section 12 of Article 17 of the Spanish Horizontal Property Act introduced by Royal Decree-Law 7/2019 of 1 March, on urgent measures in housing and rental.
