VIVIENDA FAMILIAR Y SUBROGACIÓN HIPOTECARIA EN TIEMPOS DE CRISIS: NOTAS SOBRE LOS PACTOS INTERNOS ENTRE CODEUDORES SOLIDARIOS.

Resumen
Este trabajo tiene por objeto el análisis de las fórmulas de financiación elegidas para la adquisición del hogar familiar y las consecuencias de la suscripción por las partes, bien de derechos reales de garantía o de otras vías de garantía adicional para reforzar el derecho del acreedor hipotecario. Adicionalmente este sistema de contratos y derechos reales de garantía se ha enmarcado en el momento actual de crisis económica y de resistencia por las entidades financieras para la concesión de préstamos o créditos. Especialmente se analiza y compara el régimen de la denominada acumulación pasiva de deuda, la fianza y la solidaridad a la luz de la doctrina del Tribunal Supremo y su clásica Sentencia de 28 de septiembre de 1960 revitalizada por la Dirección General de los Registros y Notariado, en particular por la Resolución de 21 de diciembre de 2005.
Abstract
This work has for object the analysis of the financing for the acquisition of the family home and the consequences of the subscription for the parts, well of real rights of guarantee or other additional guarantee to reinforce the hypothec creditor's right. Additionally these systems of contracts and real rights of guarantee have been framed in the current moment of economic crisis and of resistance for the bank for the concession of credits. Especially it is analyzed and it compares the denominated passive accumulation of debt, the guarantee and the solidarity of the doctrine of the Supreme Tribunal and their classic Sentence of September 28 1960 revitalized by the General Managements of the Registrations and Notary, especially the Resolution of December 21 2005.
