Resumen

El artículo analiza la venta de la cosa común realizada por uno solo de los copropietarios. La doctrina jurisprudencial mayoritaria considera que ese contrato de compraventa es nulo por infracción de los artículos 397 y 1261 del Código Civil. En el estudio se pretenden refutar las razones por las que la jurisprudencia decreta la nulidad de este contrato. Así, se analiza el artículo 397 del Código Civil, su origen, sus precedentes, sus posibles interpretaciones y se llega a la conclusión de que el precepto no debe aplicarse a los actos de disposición jurídica sobre la cosa común. De igual modo, en el trabajo se argumenta que el contrato celebrado por uno solo de los copropietarios sobre la cosa común, en principio, tiene consentimiento, objeto y causa. La conclusión a la que se llega en el artículo es que el contrato de compraventa de la cosa común celebrado por uno de los copropietarios es válido obligacionalmente y, si así lo desea el comprador, puede servir de título suficiente para transmitir el derecho de copropiedad que sobre la cosa tuviera el copropietario vendedor.

Abstract

The article analyzes the sale of the common good by one of the coowners. Mostly the jurisprudence considers that this contract of sale is invalid for the infringement of the arts 397 CC y 1261 CC. In the study, it is intended to refute the reasons why the jurisprudence decrees the nullity of the contract. Thus, the article 397 CC is analyzed, its origin, its precedents, its possible interpretations, and, in this way, it concludes that the provision should not be applied to the acts of legal disposal about the common good. Similarly, in the study is argued that the contract held by one of the coowners about the common good, in principle, is consented, has object and cause. The conclusion reached by this article is that the contract of sale of the common good held by one of the coowners is valid contractually and, if so desired by the purchaser, can serve of title deed, capable of transmitting the right of coownership left over the common good, that the coowner seller had.
