Resumen
La interpretación correctora del artículo 87.6 de la Ley Concursal (mayoritariamente aceptada) frente a la denominada interpretación literal, no puede mantenerse si no es desde la adopción de postulados propios de la jurisprudencia de intereses y del utilitarismo interpretativo, así como desde una errónea e indebida ponderación de los intereses en conflicto ante la reconocida perversidad de la norma.
Abstract
A majority has accepted the corrective interpretation of article 87.6 of the Bankruptcy Law over the literal interpretation, but it is impossible to maintain the corrective interpretation without adopting the postulates of case law on interests and interpretative utilitarianism and without weighting the interests in conflict erroneously and unduly in response to the acknowledged wrongness of the rule.
