UNA NUEVA REFLEXIÓN SOBRE LA SINGULARIDAD JURÍDICA DE ALGUNAS PROPIEDADES INMOBILIARIAS: ESPECIAL REFERENCIA A LOS ADARVES, ENGALABERNOS Y COBERTIZOS. CUESTIONES ACTUALES Y PROYECCIÓN DE FUTURO.

Resumen
La finalidad de este estudio es doble: por un lado, se trata de hacer hincapié en la necesidad de proteger, con carácter general, nuestro rico patrimonio inmobiliario histórico, sin olvidar a sus propietarios, analizando algunos supuestos singulares que, por su falta de clara configuración jurídica, han dado lugar a numerosos problemas de tipo práctico. Por otro lado, y basándonos en esas formas singulares inmobiliarias históricas que deben ser preservadas, se hace una propuesta de regulación general de estos complejos inmobiliarios más «simples», fundamentada en algunas normas aisladas y en la enseñanza de la doctrina y la jurisprudencia, con el propósito de que pueda servir también a situaciones arquitectónicas y urbanísticas que se están produciendo en la actualidad, y con las que se aprecia «identidad de razón».
Abstract
This study has a double target: on the one hand, we will try to emphasize the necessity of protecting with general character our rich historic real-estate heritage, and also its propietaries, analyzing some singular assumptions that, lacking of legal settings, have lead to numerous practical problems. On the other hand, basing on these singular real-estate historic form, that must be preserved, it is done a proposal of general regulation of these «simpler» property complexes, based on some isolated rules and on the teaching of the doctrine and jurisprudence, with the purpose of it to also serve to architectonic and urbanistic situations taking place nowadays, and with which it is appreciated «ratio identity».
