Resumen
La existencia de los registros sobre bienes inmuebles ha sido por mucho tiempo un mecanismo garante de la seguridad jurídica debido a la protección que brindan al titular inscrito y a la información veraz y oportuna que presta a las personas naturales y jurídicas. Dicha información respalda las relaciones civiles y económicas que estos establecen, por lo que constituye un instrumento de cognoscibilidad legal. Este funciona hoy como en el siglo XIX, es decir, sustentando su datos solo en formato papel; sin embargo, la preeminencia de un mundo dominado por las tecnologías de la información y las comunicaciones y su inclusión en todos los sectores de la vida se imponen también en el ámbito registral siendo necesario un cambio en su organización y funcionamiento. La sociedad hoy está en constante movimiento, con ella el tráfico económico y dentro de este gana especial relevancia la celeridad con que fluctúan las titularidades sobre bienes inmuebles, por lo que un sistema registral sobre la base de soporte papel no logra responder a la dinámica actual, encontrándose una posible respuesta en la digitalización de dichos registros; proceso que debe tener en cuenta la integración de todos ellos y su posterior informatización mediante bases de datos que permitan centralizar la información, organizar el trabajo y facilitar los trámites que en ellos se realizan. Se trata de una meta que entraña dificultades, pero cuyo objetivo principal descansa en el desempeño armónico y coordinado de estas instituciones como fuente primaria de información.
Abstract
The existence of a registration of real estates have been for a long time a guarantor mechanism due to the protection given by the registered holder and the truthful and appropriate information that this registration gives to native and legal individuals. This information supports the civil and economic relations established by these individuals, constituting an instrument of legal knowledge. Nowadays, this instrument works as in XIX century, which means that the information is held only in paper format. However, the preeminence of a world ruled by Technologies of Information and Communications and the inclusion of them in all sectors of daily life are imposed in the legal field which requires a change in its organization and its function. Today, society is in constant movement, jointly with the economic traffic; and within this field, it is important to highlight the celerity of holders of real estates. For that reason, a registration system based on a paper format does not respond to the traffic dynamics, even if there is a possible answer in the digitalization of such registrations. This process ought to take into consideration the integration of all registrations and their later information by means of databases that allow centralization of information, organization of work, and facilitation of the procedures in which they are developed. This is a goal with a lot of difficulties, whose principal objective lies on the harmonic and coordinated performance of these institutions as primary source of information.
