Resumen
En este trabajo se analizará el régimen de la responsabilidad por las cantidades entregadas de modo anticipado por el comprador adquirente de viviendas en construcción. Partiendo de un análisis de las normas aplicables, se estudiarán y concretarán las obligaciones del promotor-vendedor y las notas que caracterizan la responsabilidad de este, del asegurador, del avalista y de la entidad de crédito depositaria de esas cantidades anticipadas. Todo ello fundamentalmente atendiendo a la doctrina del Tribunal Supremo dictada en los últimos años acerca de este especial régimen tuitivo del comprador previsto en España.
Abstract
In this work, it will be analyzed the responsibility regime for the amounts delivered in advance by the purchaser of homes under construction. Starting from an analysis of the applicable norms, the obligations of the promoter-seller and the notes that characterize the responsibility of the latter, the insurer, the guarantor and the depository credit institution of these anticipated amounts will be studied and specified. All this fundamentally in accordance with the doctrine of the Supreme Court issued in recent years about this special buyer protection regime provided in Spain.
