Resumen
El sistema de título y modo es el sistema más característico de transmisión de la propiedad y derechos reales de nuestro ordenamiento. La peculiar yuxtaposición de estos dos elementos hace que se transmita el dominio de una forma compleja y peculiar, y que la falta de cualquiera de ellos impida que podamos hablar de un nuevo propietario con todo lo que ello conlleva de efectos frente a terceros. Analizamos en este artículo los requisitos que ha establecido la jurisprudencia para que se produzca la efectiva transmisión de la propiedad a través de este sistema, sus efectos y su categorización como tal, con el fin de explicar realmente cuándo se produce o no la transmisión dominical.
Abstract
He title and mode system is the most characteristic system of transmission of property and real rights in our legal system. The peculiar juxtaposition of these two elements means that the domain is transmitted in a complex and peculiar way, and that the lack of any of them prevents us from talking about a new owner with all that this entails of effects against third parties. In this article we analyze the requirements established by jurisprudence for the effective transmission of property to take place through this system, its effects and its categorization as such, in order to really explain when the Sunday transmission occurs or not.
