Resumen
El derecho a la propiedad es un derecho constitucional digno de protección frente a cualquier injerencia que trate de hacerse en él. En los últimos años, la protección a la propiedad, sobre todo la inmobiliaria, parece que se diluye, cede ante determinados supuestos a los que no puede hacer frente el propietario. No obstante, el propietario, el titular dominical tiene en su mano acciones y medios para defender su derecho, entre ellos, la acción reivindicatoria, acción real por excelencia, que pretende devolver al propietario la posesión de aquello que le pertenece y se encuentra en manos de otro. En este artículo se hace un repaso y análisis crítico de los presupuestos y requisitos de esta acción, con el fin de ver cómo han ido evolucionando en el tiempo y poder concluir si se han relajado o, por el contrario, cada vez son más exigentes, mermando las posibilidades de defensa del titular dominical a la hora de tratar de recuperar el bien objeto de dominio.
Abstract
The right to property is a constitutional right worthy of protection against any interference that tries to be done in it. In recent years, property protection, especially real estate, seems to be diluted, yielding to certain assumptions that the owner cannot face. However, the owner has in his hand actions and means to defend his right, among them, the claim action, real action par excellence, which seeks to return to the owner the possession of what belongs to him and is in the hands of other. This article reviews and critically analyzes the budgets and requirements of this action, in order to see how they have evolved over time and to be able to conclude whether they have relaxed, or on the contrary, they are becoming more and more demanding. diminishing the possibilities of defense of the proprietary owner when trying to recover the property subject to ownership.
