Resumen
La prueba acredita que la demandada está afectada por una incapacidad total y permanente que limita funcionalmente la capacidad para regir su persona y administrar sus bienes. Fijación por el TS de las reglas interpretativas que permiten compaginar el sistema constitucional de protección de las personas con falta de capacidad con la Convención de Nueva York de 13 diciembre 2006, sobre los derechos de las personas con discapacidad, y con lo establecido en el Código Civil a partir de la reforma de 1983.
Abstract
The evidence shows that the defendant is fully and permanently incapacitated such as to place a functional limit on her capacity to govern herself and to control her property. Setting by the Supreme Court of the rules of interpretation that enable the constitutional system of protection for persons of less than full ability to be reconciled with the New York Convention of 13 December 2006 on the Rights of Persons with Disabilities and the terms of the Civil Code after its 1983 reform.
