Resumen
La legislación chilena reguló en el año 1994 la institución de los bienes familiares. En dicha normativa se optó por un sistema formal de afectación o constitución de bienes familiares tanto respecto del inmueble que sirve de residencia principal de la familia como de los muebles que lo guarnecen. Dicho sistema formal considera, principalmente,
la intervención judicial y mecanismos de publicidad. Lo anterior, en directa correspondencia, por un lado, con los diversos intereses involucrados y, por otro, con los efectos que la afectación genera, aparece como un mecanismo adecuado, pues permite conciliar aquellos y concretar estos. En este breve artículo se pretende revisar las formas establecidas por el legislador para la afectación y desafectación de bienes familiares, dando cuenta de las principales controversias e interpretaciones que el sistema de constitución y desafectación ha generado.
Abstract
In 1994 Chilean legislation regulated the institution of family property. Chilean lawmakers opted to institute a formal system of encumbrance or creation of family property, encompassing the immovable property that is the family's main residence as well as the chattels with which the home is fitted. This formal system places its primary focus on judicial intervention and reporting mechanisms. This, in direct correspondence with, first, the various interests involved and, second, the effects encumbrance generates, appears to be an adequate mechanism, for it enables the reconciliation of the former and the specification of the latter. This short article proposes to review the forms established by legislators for the encumbrance and disencumbrance of family property, giving an account of the main controversies and interpretations that the creation and disencumbrance system has generated.
