Resumen
Se plantea y reflexiona acerca de la importancia del parentesco en nuestro ordenamiento jurídico, en especial con relación al parentesco en la sucesión intestada. Nuestro Código civil se refiere a los parientes colaterales hasta el cuarto grado para el llamamiento intestado. Se parte de un parentesco por consanguinidad, pero al no distinguir expresamente y dada nuestra tendencia a equiparar muchas situaciones similares, considero que habría que replan- tearse el sistema tradicional desde la aprobación de la Constitución Española. Igualmente debe darse una unificación en las distintas disciplinas jurídicas que hablan de parentesco.
Abstract
It raises and reflects on the importance of kinship in our legal system, especially in relation to kinship in the untested succession. Our Civil code refers to the collateral relatives up to the fourth grade for the unattended appeal. It is part of a kinship by consanguinity, but by not distinguishing ex- pressly and given our tendency to equate many similar situations, I consider that the traditional system should be reconsidered since the adoption of the Spanish Constitution. There should also be a unifying in the different legal disciplines that speak of kinship.
