Resumen
El hecho de que en el Anteproyecto de Código Mercantil desaparezca la prohibición de la rescisión por lesión en la compraventa mercantil tal y como hace el vigente artículo 344 del Código de Comercio puede suscitar de nuevo el problema sobre la aplicación supletoria o no del derecho civil autonómico correspondiente y reconocedor de dicha institución, en función de la interpretación que se realice también de la sustitución del término «Derecho común» por el de «legislación civil», que también se realiza en el Anteproyecto de Código Mercantil.
Abstract
Section 344 of the prevailing Spanish Code of Commerce prohibits the pre-eminently regional Spanish legal concept of rescission due to injury in business sales. The preliminary Business Code bill no longer does so, and therefore it may revive the problem of whether or not regional civil law that does recognize rescission due to injury should be applied in a supplementary capacity. The answer also depends on the interpretation of another change in the preliminary Business Code bill, the replacement of the term «general law» with «civil legislation».
